Welcome to the website of SOZARA Health and Longevity, a trade name of SOZARA Group, LLC ("SOZARA," "we," "us," or "our").

These Terms & Conditions ("Terms") govern your access to and use of the SOZARA website, including any content, features, forms, scheduling functionality, educational materials, communications, and other services made available through the website (collectively, the "Website").

By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website.

1. WEBSITE PURPOSE

The Website is intended to provide general information about SOZARA, our healthcare professionals, services, programs, membership offerings, educational resources, and related business activities.

The information provided through the Website is for general informational and educational purposes only. It is not intended to constitute medical advice, diagnosis, treatment, or a substitute for an examination, consultation, or individualized care from a qualified healthcare professional.

Information on the Website should not be relied upon as a substitute for professional medical advice.

2. NO MEDICAL ADVICE OR TREATMENT THROUGH THE WEBSITE

Nothing contained on the Website creates a physician-patient, nurse practitioner-patient, provider-patient, or other healthcare relationship merely through your use of the Website.

Submitting an online form, online assessment, requesting an appointment, sending an electronic message, communicating through the Website, or reviewing Website content does not by itself establish a provider-patient relationship.

Healthcare services are provided only after SOZARA determines that a patient-provider relationship is appropriate and the applicable patient intake, consent, and other requirements have been completed.

Do not rely on Website communications for diagnosis or treatment of a medical condition.

3. NOT FOR EMERGENCIES

THE WEBSITE AND ITS COMMUNICATION FEATURES ARE NOT INTENDED FOR MEDICAL EMERGENCIES.

If you believe you are experiencing a medical emergency, call 911 or go immediately to the nearest emergency department.

Do not use the Website, email, text messaging, appointment-request forms, or other non-emergency communication methods to seek immediate medical assistance.

4. HEALTHCARE SERVICES

SOZARA may offer healthcare services including, without limitation:

  • Concierge primary care;
  • Functional and longevity medicine;
  • Preventive and wellness services;
  • Weight management and medical weight-loss services;
  • Hormone-related healthcare;
  • Peptide-related services;
  • Aesthetic medical services;
  • Telehealth services; and
  • Other healthcare services offered by SOZARA from time to time.

The availability and appropriateness of any service, treatment, medication, procedure, program, or therapy is determined by the treating healthcare professional based upon the patient's individual circumstances and applicable law.

Descriptions of services on the Website do not guarantee that any particular treatment, medication, procedure, or service will be recommended, prescribed, provided, or appropriate for any particular person.

5. TELEHEALTH SERVICES

SOZARA may provide healthcare services through telehealth when clinically appropriate and permitted by applicable law.

Florida law recognizes telehealth as including the use of telecommunications technology to provide healthcare services such as assessment, diagnosis, consultation, treatment, monitoring, and related services. Telehealth providers are required to practice within their applicable scope of practice and consistent with the professional standard applicable to in-person care.

Telehealth services may be subject to additional consent, identity verification, technology, geographic, licensure, and clinical requirements.

The location of the patient at the time telehealth services are provided may affect whether and how services can legally be provided. SOZARA may decline or discontinue telehealth services when required by law, professional standards, clinical circumstances, licensing requirements, or other applicable restrictions.

6. APPOINTMENTS AND REQUESTS FOR CARE

Submitting an appointment request through the Website does not guarantee an appointment.

An appointment is not considered confirmed until SOZARA or its authorized scheduling system confirms the appointment.

SOZARA reserves the right to reschedule, modify, or cancel an appointment when reasonably necessary, including for clinical, operational, technological, staffing, or other legitimate reasons.

Additional appointment, cancellation, late-arrival, and no-show policies may apply and may be provided separately to patients.

7. MEMBERSHIPS AND PROGRAMS

Certain SOZARA services may be offered through membership programs, packages, programs, subscriptions, or other recurring arrangements.

The specific terms governing a membership or program—including fees, billing frequency, minimum commitment, cancellation, included services, exclusions, credits, expiration provisions, and other conditions—may be contained in a separate Membership Agreement, Financial Policy, Program Agreement, or other patient agreement.

If there is a conflict between these Terms and a separate written agreement governing a specific healthcare service or membership, the specific agreement will control to the extent of the conflict.

Membership fees do not guarantee any particular medical outcome, diagnosis, treatment, prescription, procedure, or other healthcare result.

8. FEES AND PAYMENTS

Unless expressly stated otherwise, SOZARA operates on a cash-pay basis and does not submit claims to health insurance for routine services. However, some services are eligible for HSA and FSA. It is the patient’s responsibility to check with his/her HSA/FSA provider to confirm.

Fees for memberships, consultations, programs, procedures, products, laboratory services, medications, or other services may vary and may be changed from time to time.

Prices displayed on the Website are subject to change and may not include third-party charges, laboratory fees, medication costs, pharmacy charges, or other expenses unless expressly stated.

Patients are responsible for charges applicable to services they authorize or receive.

Additional financial terms may be governed by SOZARA's Financial Policy, Membership Agreement, or other applicable agreement.

9. PRESCRIPTIONS AND MEDICATIONS

The Website does not guarantee that any prescription medication, compounded medication, controlled substance, hormone therapy, peptide, supplement, or other product will be prescribed or recommended.

Prescribing decisions are made by an appropriately licensed healthcare professional based upon the patient's clinical circumstances, applicable law, professional standards, and the provider's independent clinical judgment.

A request for a medication or treatment does not create an obligation for SOZARA or its healthcare professionals to prescribe or provide that medication or treatment.

10. EDUCATIONAL AND WELLNESS INFORMATION

The Website may contain information regarding nutrition, exercise, wellness, longevity, functional medicine, aesthetics, weight management, hormones, peptides, supplements, medications, and other health-related subjects.

Information concerning patients and protected health information is subject to applicable federal and state privacy laws and, where applicable, SOZARA's Notice of Privacy Practices.

The Website Privacy Policy and Notice of Privacy Practices are separate documents and should be reviewed independently.

Nothing in these Terms is intended to modify rights or obligations imposed by applicable privacy or healthcare laws.

22. INDEMNIFICATION

To the maximum extent permitted by law, you agree to indemnify and hold harmless SOZARA and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from your unlawful use of the Website, violation of these Terms, or submission of fraudulent, misleading, or unauthorized information.

This provision does not require you to indemnify SOZARA for liability that cannot lawfully be shifted to you.

To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or your use of the Website shall be brought in the state or federal courts located in or serving Flagler County, Florida, and you consent to the jurisdiction and venue of such courts.

Nothing in this section is intended to override any mandatory venue, jurisdiction, arbitration, administrative, healthcare, telehealth, consumer-protection, or other legal requirement that applies to a particular claim.

24. DISPUTE RESOLUTION

Before initiating litigation concerning a dispute arising solely from the use of the Website or these Terms, the parties are encouraged to attempt in good faith to resolve the dispute informally.

Nothing in this section prevents either party from seeking emergency or injunctive relief when appropriate or from pursuing any remedy that cannot lawfully be waived.

Healthcare claims, professional liability claims, patient disputes, and other matters may be subject to separate agreements, statutory requirements, administrative procedures, or other applicable legal requirements.

25. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

26. NO WAIVER

SOZARA's failure to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision in the future.

27. CHANGES TO THESE TERMS

SOZARA may modify these Terms from time to time.

The updated Terms will be posted on the Website with a revised "Last Updated" date.

Your continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

28. ENTIRE AGREEMENT

These Terms, together with any policies or agreements expressly incorporated by reference, constitute the agreement governing your use of the Website.

These Terms do not replace or supersede any separate patient consent, treatment agreement, membership agreement, financial policy, telehealth consent, Notice of Privacy Practices, or other agreement applicable to healthcare services.
